    Who Can Seek Wrongful Death Damages?

    CO. Rev. Stat. § 13-21-201 outlines who can file a wrongful death lawsuit in Colorado and how long they have to pursue the case.

    According to the law, only the deceased’s surviving spouse may file suit in the first year after death unless the spouse elects in writing to allow the deceased’s children to file a claim or join the claim. In the second year after death, the spouse, children, spouse and children, or any “designated beneficiary of the deceased” can file a case.
