How Can Our Personal Injury Attorneys Help You?

After an accident, you’re likely dealing with unexpected stresses, such as trying to accomplish daily tasks while in pain or worrying about medical bills. Taking on a personal injury claim can address some of your financial worries, but it also adds more things you have to do. Our law firm can manage the legal process for you, allowing you to focus on recovering.

We can:

  • Complete and file all paperwork, ensuring accuracy
  • Investigate to determine all liable parties
  • Gather evidence to support your injury claim
  • Negotiate with the insurance company
  • Guide you through the settlement process
  • Update you on your case’s progress
  • Answer any questions you have throughout your case
  • Determine which court has jurisdiction over your case and represent you at trial if necessary

At The Paul Wilkinson Law Firm, LLC, several of our personal injury attorneys once worked for insurance companies. This means we have an insider’s knowledge of their tactics and how they might try to deny your claim or lower your settlement. We combat these tactics with a well-built case that proves your need for fair compensation.

You may feel like you’re facing an impossible task, but you’re not alone. We can be beside you from the beginning of your case until its end.

What Accident Losses Can Be Compensated?

We’ve recovered over $125 million for injury victims just like you. Our goal is to seek the maximum compensation you qualify for, but settlements vary depending on the specifics of a case. We will listen to your story, review your losses, and, in some cases, consult with medical or financial experts about what losses you can expect in the future.

Below are some losses that are typically covered:

Medical Expenses

Pedestrian accidents can cause severe damage to your body, including broken bones, spinal cord injuries, traumatic brain injuries, lacerations, and internal organ damage. The medical costs of these injuries can be overwhelming. However, you may be able to recover compensation for expenses like:

  • Emergency medical services, such as from UCHealth Greeley Hospital
  • Hospitalizations
  • Doctor and medical specialist appointments
  • Diagnostic testing
  • Prescription medications
  • Medical equipment, such as crutches and other mobility aids
  • Long-term nursing care
  • Gas and mileage to and from medical appointments

Keep track of your medical bills and any receipts for your out-of-pocket expenses related to your medical care. This makes it easier for our legal team to seek reimbursement for those costs.

Job Losses

While recovering, you might have to miss weeks of work, losing out on income and eating up any PTO you’d acquired. Your injuries may also prevent you from returning to your job at the same level. You may be eligible to recover job-related losses like:

  • Loss of benefits, such as PTO and bonuses
  • Lost wages
  • Diminished earning capacity

Non-economic Losses

While financial losses from an accident can be serious, they aren’t the only way you’ve been harmed. You may be dealing with physical pain and the emotional trauma it causes, or you may no longer be able to engage with the world the way you once did. You could recover compensation for non-economic losses that have affected your life, such as:

  • Physical pain and suffering
  • Emotional distress
  • Loss of enjoyment of life
  • Loss of quality of life

Wrongful Death

When a loved one passes away after an accident, you may be unsure whether there’s a way to hold the negligent party responsible. Our wrongful death lawyers can seek justice and compensation so you can focus on grieving rather than on the financial pressures of your loss. You may be able to seek compensation for:

  • The loss of a loved one’s economic support
  • Their medical bills after the accident
  • Loss of companionship
  • Loss of guidance and parental support for children who have lost a parent
  • Funeral expenses
  • Burial costs

Establishing Negligence in Pedestrian Accidents

Personal injury cases rely on proving that someone else’s negligence caused your injuries. In pedestrian accident cases, the liable party is often a motor vehicle driver, but there may be unique situations where that is not true or where there is more than one liable party. This may be the case if:

  • A commercial driver was involved and their company is vicariously liable for their actions
  • Hazardous road conditions contributed to the accident, in which case a government entity may be liable
  • A defective part, such as faulty brakes, were the cause of the accident, meaning the manufacturer is liable

To prove that a party acted negligently, your lawyer will need to establish that your case meets four key criteria. These criteria are:

Duty of Care

Duty of care refers to one party’s responsibility towards another. You uphold a duty of care when you act in a responsible manner that keeps others safe. For example, following traffic laws would be upholding a duty of care.

Breach of Duty of Care

When someone doesn’t act in a reasonable and safe manner, they breach their duty of care. Some examples of this include:

  • Speeding
  • Failing to yield to pedestrians
  • Driving while distracted, such as texting or talking on the phone
  • Driving while under the influence of drugs or alcohol

To prove that someone’s action breached their duty of care, your lawyer will complete a thorough investigation and may use evidence like:

  • Phone records to prove they were distracted
  • Police reports that show they were intoxicated
  • Video footage of the accident, such as from a traffic camera or security camera

Causation

While distracted driving or speeding are careless acts, they don’t always result in accidents. Your lawyer must also prove that the breach led directly to your injuries. We may do so with evidence like:

  • Statements from eyewitnesses
  • Accident reconstruction

Damages

Finally, your lawyer will need to show that you suffered losses because of the accident. This is often proved with medical records that describe the injury you sustained and financial documents that demonstrate monetary losses.

How Long Do You Have to Pursue Your Case?

There are two main legal reasons to move quickly after an accident. The first is that important evidence may be lost if you wait too long. For example:

  • Surveillance cameras are often overwritten after a set period of time. Footage of the accident may therefore not be available for long.
  • Eyewitness statements can become less reliable as a witness’ memory of the event fades.
  • Physical evidence at the accident scene can be lost or be worn away, such as with skid marks.

The second reason is Colorado’s statute of limitations for personal injury lawsuits. Under CO. Rev. Stat. § 13-80-101, you generally have three years to file a personal injury lawsuit in cases where a motor vehicle was involved. After the three years is up, you may be barred from recovering compensation. Exceptions do apply, though, so it’s important to discuss this timeline with your lawyer promptly.
